Website Terms and Conditions of Use – "unOriginal" Campaign

This document establishes the terms and conditions of use of the website/platform: unoriginal.work (hereinafter referred to as the "Platform") related to the "unOriginal" social campaign ("Campaign"), organized by MULLEN LOWE S.A.

I. The Object and Organizer of the Campaign

The purpose of this document is to establish the conditions for participation in the “unOriginal” Campaign, which is being carried out for an unlimited period through the Platform. The Campaign Organizer is MULLEN LOWE S.A., with registered office in Bucharest, Str. Grigore Alexandrescu no. 89-97, Building B, Floor 3, Module A, Sector 1, registered with the Trade Register under no. J40/25070/1994, Unique Registration Code RO 6645758, hereinafter referred to as the “Agency”, which implements this Campaign for its end client Raiffeisen Bank S.A..

II. Conditions of Participation

The campaign is addressed to Raiffeisen Bank's Romania clients and potential clients, NGOs, advertising agencies and any person who wishes to upload materials with social and humanitarian purposes to the Platform.

III. Campaign Mechanism

To participate in the Campaign, participants must access the Platform, create an account, accept the Terms and Conditions and Privacy Policy and complete the registration form with the requested data, namely: Name, Surname, Email Address.

By completing the form, participants confirm that they have read and accepted the Terms and Conditions included in this document.

Materials can be uploaded by users using the Upload campaign button in the "My Account" section. Any user can download a material uploaded to the Platform by accessing the material and pressing the Download button.

Materials uploaded to the platform are of two types: public or private. Public materials are accessible even to users who do not have an account on the platform, and private materials are available only to users who have an account on the platform.

To successfully upload a material to the website, please complete the upload form, especially the mandatory fields, and respect all disclaimers mentioned in this form regarding file size and format.

IV. Limitation of Liability

The Agency does not assume responsibility for any technical malfunctions of the Platform, data transmission errors, or the impossibility of participation caused by external factors. Participants assume full responsibility for the correctness of the data entered in the form / Platform.

VI. Intellectual Property Rights

The content of the Platform, including but not limited to texts, images, graphics, logos, is protected by copyright and related rights legislation.

The Platform may contain materials, images, texts, videos, graphics or other types of content ("Materials") that are provided or uploaded by users.

Certain Materials may be protected by copyrights, trademarks or other intellectual property rights belonging to third parties. Since these materials are not created or fully owned by the Agency, it does not guarantee that their use by other users will not infringe the rights of third parties.

Users are strictly prohibited from downloading and using materials uploaded to the platform in which people or voices of people appear. These are uploaded mainly for the purpose of inspiration for users.

Users may view, distribute or reuse the Materials available on the Platform only to the extent permitted by applicable copyright legislation and for purposes that do not prejudice the owners of these rights.

The Agency assumes no liability for any infringements of copyright or other intellectual property rights resulting from the use of Materials published on the Platform by users and does not guarantee their licensing, authenticity or royalty-free nature.

If a person considers that content available on the Platform infringes their copyright or other intellectual property rights, they may request the removal of said content by sending a notification to the following address: Bucharest, Str. Grigore Alexandrescu no. 89-97, Corp B, Etaj 3, Modul A, Sector 1, Romania, or to the following address: support@unoriginal.work with the title: Copyright infringement unOriginal Platform, accompanied by the relevant evidence.

For clarity, the platform acts as an intermediary of the content, not as the rights holder.

The Agency grants a non-exclusive license, unlimited in time and space, to the materials uploaded to the platform.

Users of the Platform may upload, publish or distribute on the Platform materials such as texts, images, audio-video recordings, comments, graphics or other types of content (“User Content”) with an exclusive social or humanitarian purpose.
By uploading any Content to the Platform, the user declares and guarantees that:
  • (i) he/she is the owner of all intellectual property rights over the respective content, or that he/she has the express authorization of the rights holders to use and distribute it through the Platform;
  • (ii) the content does not infringe the copyrights, trademarks, trade secrets, right to privacy, image or other legal rights of any third party;
  • (iii) the content is not defamatory, obscene, discriminatory, violent, illicit or contrary to good morals.
By uploading Content, the user grants the Agency a non-exclusive, royalty-free, irrevocable, perpetual, transferable and sublicensable license to use, reproduce, adapt, modify, translate, publish, distribute and publicly communicate the respective content, for the purpose of operating, promoting or improving the Platform.

The user remains the owner of the copyrights on his/her own Content, but understands and accepts that, by publishing it on the Platform, other persons may view, distribute or reuse it under the terms of the law.

The Agency does not verify in advance the content uploaded by users and does not assume responsibility for its veracity, legality or compliance. To the extent that it receives a notification regarding a possible copyright infringement, the Agency may remove or block access to the respective content without prior notice.

Users are directly liable for any damage caused to the platform, other users or third parties by the published content.

Users who upload Materials to the Platform grant the Agency and other users their express consent for the commercial use of the Materials.

Any contrary use will be considered illegal, and the persons in question may be sued by the copyright holders under the terms of the law.

The materials uploaded by users to the platform must have a social or humanitarian purpose.

In the event that a user uses bots to upload materials to the Platform and the Agency is unable to react in a timely manner to remove them (for example during legal holidays, days off, etc.), users who will download materials assume that the Platform is public, that anyone can upload any kind of material and that in the event that there are bugs / errors / incorrectly uploaded or unverified materials, they assume that they will download them at their own risk.

VII. Personal Data Protection

The following personal data are collected within the Campaign: name, surname, e-mail address. These data will be used exclusively for the administration of the Campaign and for the fulfillment of legal obligations by the Agency.

Personal data will be processed in accordance with applicable data protection legislation, including (Regulation (EU) 2016/679 – GDPR). Participants have the right to access, rectify, delete, restrict, object and portability of data, by a request sent to the Agency at the email address: dpo.bucharest@mullenlowe.ro or at the Agency’s headquarters. The detailed conditions regarding the processing of personal data are included in the Privacy Policy section included in the Platform.

VIII. Disputes and Applicable Law

Any disputes arising between the Agency and the participants will be resolved amicably, otherwise, the jurisdiction belongs to the courts of Bucharest. The applicable law is Romanian law.

IX. Modification of Terms and Conditions

The Agency reserves the right to modify this document at any time, with the obligation to publish the updated version on the Platform. The modifications will enter into force from the date of publication or at a later date depending on the Agency's decision.
